New Jersey Accepts Actuarial Verification of Washington State Reserve Reports

New Jersey reinstated an old regulation to require actuarial verification of New Jersey state reserve reports IF a charity offers flexible deferred gift annuities (FGAs). In a stunning update, New Jersey has now decided that it will accept a Washington state reserve report that has been verified by an actuary, provided that it is submitted with an unverified New Jersey or New York state reserve report and a NJ certificate of valuation.

Nothing Happens Until Somebody Dies – Thoughtful Planning for Testamentary Gifts

We get a fair number of client inquiries regarding testamentary gifts. For bequest intentions, we typically talk about the need to discount the gifts. With testamentary life income gifts, however, there are additional questions and points of concern. The donor is contemplating the eventual establishment of a gift that will provide income to someone else after the donor’s death. That means the calculations for a testamentary CGA or testamentary CRT are predicated upon multiple layers of assumptions.

What If There Is No IRS Discount Rate?

The “IRS Discount Rate” is key to calculating the charitable deduction for split interest gifts. You know the routine: the IRS issues a new rate each month and the donor can choose the rate in effect for the month in which the gift is completed or either of the previous two months. Since 1989, the IRS has reliably issued next month’s Discount Rate around the middle of the current month. But what happens if, due to the Federal shutdown, the IRS is late? Or what if it doesn’t issue a November rate at all?
